NOTICE OF YOUR FINANCIAL PRIVACY RIGHTS


We, our, and us means BankWest, Inc.

This is our privacy notice for our customers. When we use the words "you" and "your" we mean the following types of customers:
  • All of our consumer customers who have a continuing relationship with us, such as:
    • Deposit account
    • Loan account
    • Credit card
    • Safe deposit box
    • Retail installment contract we hold and service
    • Self-directed Individual Retirement Account where we act as custodian or trustee
    • Financial, investment, or economic advisory services (for a fee)
    • All accounts handled through the trust department
  • All former customers
We will tell you the sources for nonpublic personal information we collect on our customers. We will tell you what measures we take to secure that information.

We first define some terms:

Nonpublic personal information means information about you that we collect in connection with providing a financial product or service to you. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records.
An affiliate is a company we own or control, a company that owns or controls us, or a company that is owned or controlled by the same company that owns or controls us. Ownership does not mean complete ownership, but means owning enough to have control.

Federal law allows us to disclose the information listed above with other financial institutions with whom we have joint marketing agreements. You do not have a right to opt out of the disclosure of this information. We may also disclose nonpublic personal information about you to nonaffiliated third parties as permitted by law.

Types of Businesses. Here are the types of businesses with whom we may disclose nonpublic personal information under this section:

Reasons For Disclosing. Here is why we may disclose nonpublic personal information about you to other financial institutions with whom we have joint marketing agreements:

Limitations on Disclosure. Here are the limitations we impose on the use of nonpublic personal information disclosed to other financial institutions with whom we have joint marketing agreements:
  • We only allow direct mail solicitations
  • We do not allow telephone solicitations

BANKWEST PROTECTS CUSTOMER INFORMATION


We maintain physical, electronic, and organizational safeguards to protect customer information. We continually review our policies and practices, monitor our computer networks, and test the strength of our security in order to help us ensure the safety of customer information.

IMPORTANT INFORMATION ABOUT OPENING AN ACCOUNT AT BANKWEST


On September 11, 2001, our lives changed forever. In an effort to protect you and our country, the USA PATRIOT Act was signed into law. To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify and record information that identifies each person who opens an account.

When you open an account, we will ask for your name, address, date of birth and other information that will allow us to identify you. We may ask to see your driver's license or other identifying documents.

As required by the Fair and Accurate Credit Transactions Act of 2003, BankWest wants to inform you that we may report information about your account to credit bureaus and/or consumer reporting agencies. Late payments, missed payments, or other defaults on your account may be reflected in your credit report and/or consumer report.

Credit Dispute Disclosure:
Notice: BankWest may furnish information about your account to consumer reporting agencies. You have the right to dispute the accuracy of the information that we have reported by writing to us at BankWest, Attn: Operations, P.O. Box 998, Pierre, SD 57501 and describing the specific information that is inaccurate or in dispute and the basis for any dispute with supporting documentation. In the case of information that relates to an identity theft, you will need to provide us with an identity theft report.

BankWest's Internet Privacy Policy


BankWest recognizes the importance of protecting the privacy of visitors to our website. Therefore, BankWest Management has adopted a privacy policy that guides how we collect, store and use personally identifiable information about our customers and website visitors. The intent is to balance our legitimate business interests in collecting and using the information against the users' reasonable expectations of privacy. The policy includes the following:
  1. Visitors to the BankWest website remain anonymous.
  2. BankWest does not collect identifying information about visitors to our site.
  3. We use standard software to collect non-identifying information about our visitors, such as:
    • Date and time our site was accessed
    • IP address (a numeric address given to servers connected to the Internet)
    • Web browser used
    • Pages viewed
    • City, State and Country
    BankWest uses this information to create summary statistics and to determine the level of interest in the information available on our site.
E-mail users should be aware that the Internet is operated over an open channel. Therefore, e-mail information is not guaranteed to be secure. We ask that visitors to our web page do not send personally identifying and/or confidential information to BankWest via e-mail. Any information visitors choose to send, however, will be used internally, as appropriate, to handle the sender's request. Such information is not disseminated or sold to other organizations. BankWest does not accept instructions to conduct banking transactions via e-mail at this time.
